1. General
KFC Europe Sarl ("Company" or “KFC”), a franchisee of KFC, which has a presence in Cyprus through CK System Franchise Limited and PHC Franchised Restaurants Limited, to whom the Company has licensed the right to use certain intellectual property in connection with the operation of stores in premises approved by the Company within the territory of Cyprus, has created the Website www.kfc.com.cy ("Website") and KFC Cyprus App ("App"), through which the Company's Services, as defined below, are made available to consumers.
These Terms of Use relate to and govern the Consumers' sign in and browsing on the Website and App, as well as their use of the Services, as defined in these Terms of Use.
BY USING OUR WEBSITE AND APP YOU ACCEPT THE TERMS AND CONDITIONS AS HEREIN DETAILED
By using our Website and App, you confirm that you accept these terms of use and that you agree to comply with them.
If you do not agree to these terms, you must not use our Website and App.
We recommend that you print a copy of these terms for future reference.
THERE ARE OTHER TERMS THAT MAY APPLY TO YOU
These terms of use refer to the following additional terms, which also apply to your use of our Website and App:
• Our Privacy Policy which sets out the ways in which we process the personal data we collect from you or that you provide to us when using the Website or App.
• The Cookie Policy which contains information about cookies on the Website and App.
Any sign in and/or use of the Services after any modification of the Terms of Use shall be deemed to constitute acceptance of such modifications and the Terms of Use, as modified, in effect at all times.
Having regard that the provision of the Services through our Website and App significantly limits human intervention, please read these Terms of Use carefully before accessing our Website or App and/or using the Services. If a Consumer does not agree with the Terms of Use, it is recommended not to enter the Website or the App, not to register and not to use the Services. KFC encourages Consumers to visit this page and read these Terms of Use periodically in order to be informed of any changes to these Terms of Use.
2. Definitions
Unless otherwise specifically stated in these Terms of Use, the following definitions apply:
"Website" and "App" means www.kfc.com.cy and its sub-pages and sections or the KFC Cyprus App
"Consumer" means the natural person who signs in the Website or the App and/or makes use of the Services.
"Store" means each and all affiliated stores of the "KFC" chain of restaurants as listed on the Website and in paragraph 18 of these Terms.
"Account" means the personal account created by the Consumer to enable him/her to use all Services.
"Terms of Use" means these Terms of Use, as may be amended from time to time.
"Order" means the electronic order submission process via the Website and/or the App, through which the Consumer orders products from the Price List.
"Price List" means the products and goods offered by KFC via the Website.
"Services" means the services offered by KFC as described in clause 4 of these Terms of Use.
3. Provided Services
The Consumer may, via the Website and the App, submit an Order for products from the Price List with the possibility of: (a) collection of the order at a point of the Consumer's choice (Delivery) or (b) collection of the order from a KFC Store of the Consumer's choice (Take Away), in both cases and with the possibility of execution and delivery/acceptance of the Order at a predetermined later point in time
The Services are available according to the opening hours of each store, as it will be displayed during the selection of the specific store, except in cases where the opening hours of the stores have been exceptionally changed or in cases where for reasons of force majeure it is not possible to sign in the Website, use the Services and submit and execute Orders.
A prerequisite for the completion of the Order Delivery Service at a point of the Consumer's choice (Delivery) is that the delivery location is served by a KFC Store.
4. Login requirements and Terms for subscription to the Services.
Simply entering and browsing on the Website and the use of some of the Services, such as placing an Order does not require or imply registration of the Consumer and creation of an Account.
Registration on the Website is optional. However, some of the features or Services offered, such as order history, may not be available to consumers who have not registered.
Therefore, and in order for the Consumer to be able to access and use all the Services provided via the Website and the App, the Consumer must create an Account.
A prerequisite for the registration, connection and use of the Services is that the Consumer must be over eighteen (18) years of age and have full legal capacity. Alternatively, the Consumer may access the Website and the Services via an existing Google account or Facebook social media account (www.facebook.com). In such cases, KFC does not post anything on the Consumer's Facebook profile. Additionally KFC does not have access to the information that the Consumer has submitted in Google and Facebook, except for the name and contact e-mail address, as a means of identification and notification. In any case, the restrictions and generally all security policies of the Website remain unchanged and regardless of how you access the Website.
5. Procedure for Account Creation.
In order to create an Account, the Consumer must provide the actual data required, namely: (a) Name, (b) Surname, (c) Telephone and (d) a valid e-mail address (e-mail address), which is also the user name, and also to create a password. Only one account can be registered per email address.
The data entered by the Consumer must be true, real and the Consumer is the legal owner of the data and is under his/her full and exclusive control. It is particularly important that the password should be kept secret and not disclosed to third parties. KFC will never ask the Consumer to disclose their password. The Consumer should not disclose the password and any communication in which the password is requested from the Consumer should be considered suspicious and treated as such by the Consumer. The mobile phone number should correspond to an active telephone connection in the Consumer's name.
The Consumer declares and accepts that in the event that the Company considers any of the above information is not true and/or does not meet the conditions and guarantee statements of the Consumer, it may, in its sole discretion and decision, cancel the Account. In this case, no liability may be borne by KFC.
In the event that the Consumer finds or believes that any of the above information has been intercepted or disclosed in any way to a third party, he/she must modify it and inform the Company immediately at https://www.kfc.com.cy/contact-us
Where applicable and depending on the nature of the requested Service, during the Order submission process, further information will be asked by the Consumer, such as full details of the delivery address of the order (address, number, postal code, floor, name on the bell). The registration of these data is a prerequisite for the completion of the Order.
In the context of the execution of the services, the Consumer may be asked to provide specific information, such as the credit or debit card number, the expiry date, the name of the holder, etc., necessary for the provision of the requested services.
The Consumer must provide true, accurate, valid and complete information regarding the data requested by the Website and/or App. Furthermore, he/she must comply with the rules and provisions of Cypriot, European and International Law and the relevant legislation governing telecommunications, on the one hand, and refrain from any illegal and abusive use of the content and Services of the Website and/or App, on the other hand. Also, he/she must behave decently, politely and discreetly during his/her visit and use of the Website and/or App, while the adoption of unfair competition practices or other practices and behaviors that are contrary to NETIQUETTE (Code of Conduct for INTERNET Users) is expressly prohibited. Any damage caused to the Company and/or KFC brand and/or the App and/or the Website resulting from the misuse or improper use of the relevant services by the Consumer/visitor is rendered within his/her sole responsibility.
6. Modification of Account details and deleting an Account.
The Consumer, after logging into his/her Account, has the right and the ability at any time to: (a) modify the information provided or (b) delete the Account by following the steps described in the relevant sections of the Website.
7. Prohibited use
You may only use our Website and/or App for legitimate purposes. You cannot use our Website and/or App:
- in any manner that violates any applicable local, national or international law or regulation.
- in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.
- to intimidate, insult, bully, alarm, upset, annoy or humiliate any person.
- to send, knowingly receive, upload, download, use or reuse any material that does not comply with our content standards as defined below
- to transmit or procure the transmission of any unsolicited or unauthorized advertising or promotional material or any other form of similar offensive material (spam)
- to send or download any material that contains viruses, trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful program or similar computer code designed to adversely affect the operation of any computer software, device, components.
You also agree:
- not to reproduce, copy, copy, interfere with, sell or generally use any part of the Website and App in violation of the provisions of the terms of use of the Website and App, including without limitation to
- not to cause unlawful injury and damage to us or any third party or violate the confidentiality or privacy of any person's information
- not to cause an offense to the morals, social values, immorality, minorities
- not to infringe any patent, trademark, trade secret, copyright or other proprietary rights of third parties of any kind,
- not to intentionally or unintentionally violate the applicable laws or regulations,
- not to harass third parties in any way,
- not to access, interfere or interrupt without authorization.

- any equipment or network on which the Website and App are stored
- any software used in the provision of our Website and App or
- any equipment or network or software owned or used by any third party.
8. Breach of policy
If we determine that you have violated the terms of the Website and App, we may take whatever action we deem appropriate to enforce our rights.
Failure to comply with the policies constitutes a material breach of the terms of use under which you are permitted to use our Website and App and may result in all or any of the following actions:
• Immediate, temporary or permanent withdrawal of the right to use our Website and App.
• Immediate, temporary or permanent removal of any Contribution uploaded by you on our Website and App.
• Issuance of a warning to you.
• Legal proceedings against you to recover all costs in compensation (including, but not limited to, reasonable administrative and legal costs) arising from the infringement.
• Further legal action against you.
• Disclosure of such information to law enforcement authorities as we reasonably believe necessary or as required by law.
We exclude our liability for any action we may take in response to violations of this accepted use policy. The actions we may take are not limited to those described above and we may take any other action we reasonably consider appropriate.
9. Policy on Submitting an Order
9.1. Delivery of the order to a point of the Consumer's choice (Delivery)
- Creating an Order
The Consumer, in order to submit an Order for delivery at a point of his/her choice, has the following options:
(a) select the field marked as "ORDER NOW", in order and after filling in his/her details or logging in through an existing Google or Facebook social media account (www.facebook.com) or selecting "Continue as a Guest", by accepting these Terms of Use and moving to the next box, select "Delivery" in order to submit an Order, the products of which will be delivered to a point of his/her choice (if this point is served by a KFC Store).
(b) select the field marked as "Menu" in order to browse the virtual price list and then select the products he wishes to order and add them to the "CART", fill in his details or log in through an existing account on Google or the social networking site Facebook (www.facebook. com) or by selecting "Continue as a Guest", accepting these Terms of Use and transferring to the next box, to select "Delivery" in order to place an Order, by adding the products he/she selects to "CART" and which will be delivered to a point of his/her choice (if this point is served by a KFC Store).
The time limits for immediate delivery and delivery at a predetermined time are indicative, refer to the average delivery time of the entire network of KFC Stores at a given time and may vary in relation to the indicative delivery time indicated on the Website, are intended for the optimal service and convenience of the Consumer and are in no way binding for KFC. KFC bears no responsibility in the event that, for any reason whatsoever, the delivery of the order is not possible within the above time limits.
At the same time, the Consumer has the option, instead of immediate delivery, to choose delivery at a predetermined day and time. In this case, the Consumer may choose to have the order delivered on a specific date within the next three calendar days from the date of the Order and at an exact time, referring to thirty (30) minute zones.
The Consumer must be at the pick-up point, which has been indicated in the Order at the predetermined time in order to receive the Order. In the event that the Consumer cannot be found for a period of 10 minutes, KFC may cancel the Order and dispose it at its sole discretion, without any liability whatsoever and the Consumer may not withdraw or request replacement or cancellation of the transaction.
- Submitting an Order
For the purpose of submitting the Order, the Consumer must necessarily fill in the relevant fields on the Website, which include: (a) the exact address of the delivery point; (b) the floor (if any); (c) the details shown on the entrance bell; (c) the contact telephone number; and (d) any specific comments in the relevant field
For the better service of the Consumer, upon starting the Order, an electronic shopping cart is created, in which the products he/she wishes to order are filled in.
KFC makes every effort to ensure that the products mentioned on the Website and/or App are available from all KFC stores that serve delivery services (Delivery). It may, however, during the execution of the Order from the nearest store to find a temporary shortage thereof. In this case, KFC will contact the Consumer to inform him/her about this and propose alternatives.
The cost of delivery is €2.20 and is additional to the cost of the products and the Price List. Further to this, there might be a minimum order requirement in some cases.
- Methods of Payment
The Consumer has the following ways to pay for the Order:
Payment in cash only, upon collection of the order from the KFC delivery driver.
Payment by credit or debit card upon receipt of the order from the KFC delivery driver via a JCC terminal.
Prepayment by credit, debit or prepaid card. Payment by credit, debit or prepaid card is made before the completion of the submission and dispatch of the Order., The credit cards accepted for the completion of the prepayment procedure and their logos are displayed in the relevant section of the Website and/or App.
All payments made using a card are processed through the JCC electronic payment platform.
As soon as the Consumer decides and proceeds to pay for the Order by charging his/her credit or debit card through the JCC electronic payment platform, it is presumed that the Consumer has read and accepted the respective terms of use and transactions of the JCC service and KFC is not liable for any transactions carried out in the above manner.
If the Consumer has a discount coupon, he/she can fill in the code he/she has in order to benefit from the discount by entering the relevant number in the "My Coupons" field.
- Completion of the Order
(a) in cases of payment marked "Cash - Pay in cash on delivery" or "Pay with your credit or debit card on delivery via JCC" the Order process is completed by selecting the "Complete Order" field, or
(b) in cases of electronic payment with the indication "Electronic", after selecting the field "Credit/Debit Card", the Consumer by clicking on the field "Order Completion" is transferred to the Payment Page where the payment is completed, after filling in the relevant fields and then completing the payment process.
Upon completion of the above procedure, the order is forwarded for execution to the appropriate KFC store and the Consumer is informed of the expected delivery time
KFC cannot guarantee (due to a technical limitation) the avoidance of delay in relation to the expected delivery time, when the delivery time is changed while the Consumer is in the process of placing an Order as it is not technically possible to inform the Consumer of any changes. In practice, this means that the Consumer, after sending his/her order online, will be informed of the delivery time that applied when he/she started the online submission of his/her order.
When the appropriate KFC store cannot serve the Consumer and execute the Order due to excessive workload, power failure, technical problem, bad weather conditions or other reasons of force majeure and the forwarding of new orders to it is interrupted, the Consumer is informed by telephone and the order is cancelled.
9.2.. Collecting an order from a KFC store (Take Away)
- Creating an Order
In order to submit an Order for collection from a KFC store (Take
Away), the Consumer has the following abilities:
(a) to select the field marked "ORDER NOW", in order and after filling in his/her details or logging in through an existing account or selecting "Continue as a Guest", accepting these Terms of Use and transferring to the next box, select "Take Away" in order to submit an Order, the products of which will be delivered from the selected KFC store, included in the relevant table on the Website.
(b) to select the field marked "Menu" in order to browse the virtual Price List and then select the products he wishes to order and add them to the "CART", fill in his details or login through an existing account or select "Continue as a Guest", acceptance of these Terms of Use and transfer to the next box, to select "Take Away", in order to place an Order, by adding the products he/she will select in the "CART" and which will be delivered by the selected KFC store, included in the relevant table on the Website.
It is noted that, due to the restrictions caused by the Covid-19 pandemic, the delivery of the products is carried out in accordance with the relevant regulatory decisions of the Cyprus Government.
Immediate delivery (I wish my order to be delivered now) means the receipt of the order by the Consumer from the Store he/she has chosen. Upon completion and submission of the Order, the Consumer's screen will display a notification, which will include the time of receipt, which is based on the exact time of dispatch of the Order.
At the same time, the Consumer has the option, instead of immediate delivery, to choose the delivery from the selected KFC store at a predetermined day and time that he/she wishes. In this case, the Consumer may choose to receive the order on a specific date within the next three calendar days from the date of the Order and at an exact time, referring to eight (8) minute zones.
The Consumer must be present at the pick-up point, which has been indicated in the Order at the predetermined time in order to pick up the Order. In the event that the Consumer cannot be found for a period of 10 minutes, KFC may cancel the Order and dispose it at its sole discretion, without any liability whatsoever and the Consumer may not withdraw or request replacement or cancellation of the transaction.
- Submitting an Order
In order to submit the Order, the Consumer must necessarily select from the list of KFC stores that appears on the screen the store from which he/she wishes to receive the Order. For the convenience of the Consumer, the exact address of each Store is displayed. It is noted that if the Consumer completes and submits his/her Order electronically using the Take Away procedure, it is not possible to subsequently request pick-up from another KFC Store.
For the better service of the Consumer, upon starting the Order, an electronic shopping cart is created, in which the products he/she wishes to order are filled in. There is no minimum order cost for orders to be picked up from a KFC store.
KFC makes every effort to ensure that the products listed on the Website and/or App are available from all KFC stores that offer takeaway services (“Take Away”). It is possible, however, during the execution of the Order by the selected store to find a temporary shortage of these. In this case, KFC will contact the Consumer to inform him/her about this and propose alternatives.
- Methods of Payment
The Consumer may pay the Order by prepayment with a credit, debit or prepaid card. Payment by credit, debit or prepaid card is made before the completion of the submission and dispatch of the Order. The credit cards and their logo, which are accepted for the completion of the payment process, are displayed, on the Website’s relevant section.
All payments made using a credit, debit or prepaid card are processed through the electronic payment platform and the JCC service.
Once the Consumer proceeds and pays for the Order by charging his/her credit or debit card through the JCC electronic payment platform, it is presumed that the Consumer has read and accepted the respective terms of use and transactions of the JCC service and KFC is not liable for any transactions carried out in the aforementioned ways.
If the Consumer has a discount coupon, he/she can fill in the code he/she has in order to benefit from the discount by entering the relevant number in the "My Coupons" field.
- Completion of the Order
After selecting the "Credit/Debit Card" field, the Consumer by clicking on the "Complete Order" field is transferred to the Payment Page where the payment is completed, after filling in the relevant fields and then completing the payment process.
Upon completion of the above procedure, the Order is forwarded to the competent KFC store for execution. In case the Consumer has not chosen to be picked up from a selected KFC store on a predetermined day and time, the Consumer is informed of the store details (address and contact phone number), the expected time of pickup.
The Consumer must come to the selected Store at the agreed pick-up time, if applicable, in order to collect his/her order. In the event that the Consumer appears late for the receipt of his/her Order, as a result of which the products ordered may not retain the properties that they had at the time of the agreed receipt (for example, the products of the Order may have cooled down), KFC bears no responsibility and the Consumer must pay the value of his/her Order, provided that he/she has chosen as a payment method the payment in the Store and cannot withdraw or request replacement or cancellation of his/her transaction.
In any case, the KFC store that executes the Order is obliged to keep it for a period of ten (10) minutes from the predetermined time of receipt. After that point in time, the KFC Store may, in its sole discretion, dispose of the Order. The time limits for immediate delivery and delivery at a predetermined time are indicative, refer to the average delivery time of the KFC Stores' network at the given time and may differ in relation to the indicative delivery time indicated on the Website and/or App, are intended to provide optimal service and convenience to the Consumer and in no case are they binding for KFC, which bears no responsibility in the event that for any reason the delivery of the Order is not possible within the above time limits.
KFC cannot guarantee (due to a technical limitation) the avoidance of delay in relation to the expected delivery time, when the delivery time is changed while the Consumer is in the process of placing an Order as it is not technically possible to inform the Consumer of any changes. In practice, this means that the Consumer, after sending his/her order online, will be informed of the delivery time that applied when he/she started the online order submission process.
When the competent KFC store cannot serve the Consumer and execute the Order due to excessive workload, power failure, technical problem, bad weather conditions or other reasons of force majeure and the forwarding of new orders to it is interrupted, the Consumer is informed by telephone and the Order is cancelled.
10. Returns/ cancellation policy
Returns Policy
In the event that: (a) there is a mismatch between the Order and the products delivered or received by the Store or (b) the quality of the delivered products does not correspond to the quality of KFC's products, the Consumer has the right to request equal compensation in kind (including, but not limited to, replacement of items or free delivery on a subsequent order).
In the above cases, if the Order is to be delivered to a point of the Consumer's choice (Delivery), the Consumer should contact immediately by e-mail info@kfc.com.cy.
Similarly, if the Order is to be collected from a selected KFC Store (Take Away), the Consumer must inform the Store manager upon receipt of the Order about the individual terms of compensation in kind.
11. Order Cancellation Policy
Before the completion of the payment process of the Order and the electronic submission, the Consumer may cancel his/her Order by removing the quantities of products from his/her basket. In the event whereby the submission of the Order has been completed, the Consumer may cancel the order only by telephone.
In case of cancellation of an order, for which a credit card has been selected as a means of payment, the cancellation of the credit card charge is authorized by the supervisors of the KFC call center. The process of refund might take more than 3 days to be completed.
When the Order cannot be serviced due to excessive workload, power failure, technical problem, bad weather conditions or other reasons of force majeure, the Consumer is informed by telephone and the Order is cancelled.
12. Intellectual Property
Any and all elements and information found and described on the Website and/or App, which are eligible for protection based on intellectual, industrial and copyright law (indicatively and not limited to images, logos, trademarks, graphics, photographs, texts, etc.), constitute the full and exclusive intellectual, industrial and copyright property of KFC and are protected under the relevant provisions of Cypriot law and international conventions.
Any copying, analogue/digital recording and machine reproduction, downloading, processing, resale and general exploitation of the Website and its content, creation of work productions or misleading the public about the real owner and provider of the content of the Website and/or App is prohibited.

KFC'S CORPORATE ENTITIES, REPRESENTATIVES, AGENTS AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, INCIDENTAL OR EXEMPLARY DAMAGES ARISING OUT OF YOUR USE OF THE WEBSITE AND APP OR FOR ANY OTHER CLAIM RELATING IN ANY WAY TO YOUR USE OF THE WEBSITE AND APP. 16. Amendment of Terms of Use
The present Terms of Use are formulated taking into account both the rapid development of technology and in particular the Internet, and the existing - although not fully developed
- legal framework on these matters. Within this context, any future relevant regulation will be the subject of this section.
In any event, KFC reserves the right to change the Terms of Use, including the terms of protection of Personal Data and the Privacy Policy, after informing the Consumers/visitors/users and within the existing or future legal framework. If a visitor/Consumer does not agree with the terms of protection of personal data provided herein, he/she must not use the services of the Website.
16. Applicable law and Jurisdiction
These Terms of Use, as they may be amended from time to time, shall be governed by Cyprus Law.
For any dispute that may arise from the use of the Services offered through the Website and which cannot be resolved out of court, the Cyprus Courts shall have jurisdiction.
